Terms & Conditions

These Terms and Conditions (“Terms”) apply to your use of the mobile application developed by Eshango Ltd, a company registered in England and Wales (Company Number 12586343) with registered offices at 25a Burma Road, London, England, N16 9BH (“Eshango”, “we”, “our”, or “us”).

By downloading or using the Eshango app (the “App”), you agree to be bound by these Terms and by our Privacy Policy (available at https://eshango.co/privacy/ ). If you do not agree, you must not download or use the App.

1. OUR SERVICES

(a) Eshango has developed the App to help users manage their business earnings, track savings deposits and withdrawals, monitor loans and repayment terms, understand cash flow, and make better financial decisions. (b) The App may also allow you to apply for loan products offered by third-party financial institutions (see section 11).

2. WHO MAY USE THE APP

(a) You must be at least 18 years old, or have the express consent of a legal guardian, to use the App.
(b) You must have legal capacity to enter into contracts in your country of residence.
(c) If these requirements are not met, you must not use the App.

3. LICENCE TO USE THE APP

(a) These Terms form an agreement between you and Eshango. Google, Apple, or any other app store provider is not a party to this agreement.
(b) We grant you a limited, non-exclusive, non-transferable licence to download and use the App on devices you own or control, provided you comply with these Terms and the rules of the relevant app store (Google Play Terms or Apple Media Services Terms).
(c) The licence starts when you download the App and covers all updates, unless they come with separate terms.
(d) You must not:

  • modify, reverse-engineer or copy the App’s code;
  • bypass or tamper with security features;
  • present the App as your own or redistribute it.
    (e) If you sell or give away your device, you must first remove the App.

4. SIGN-UP

To use the App, you must create an account and provide certain details, which may include:

(a)your name

(c)phone number

(d)date of birth

(e)valid form of identification (such as a National ID or passport).

You are responsible for ensuring that all information you provide is accurate, complete, and kept up to date.

5. SUPPORT & CONTACT

(a) Eshango provides customer support for the App. Google and Apple have no responsibility for support.
(b) You can contact us using the “Contact Us” feature in the App, or via support@eshango.co.
(c) We may contact you by email, phone, or in-app notifications.

6. PRIVACY & DATA PROTECTION

(a) Our Privacy Policy explains how we collect, use, and share personal data. By using the App, you consent to such processing in line with the Privacy Policy.
(b) We may collect technical data about your device and usage to provide updates, support, and improvements.
(c) The App may request access to your location in order to verify your business activities. If you disable location services, some features may not work.
(d) Eshango complies with the UK GDPR and Data Protection Act 2018. Both parties shall comply with applicable Data Protection Legislation.

7. YOUR CONTENT

(a) You may upload content (including images, feedback, and materials) (“Posted Materials”).
(b) You warrant that Posted Materials:

  • are accurate, lawful, and free from offensive or harmful content;
  • do not infringe third-party rights.
    (c) By uploading Posted Materials, you grant Eshango a perpetual, royalty-free, transferable licence to use, adapt, and reproduce them for the purposes of operating and improving the App.

8. OUR CONTENT

All materials in the App (text, graphics, logos, software, etc.) are owned by or licensed to Eshango. You may only use them to operate the App in line with these Terms.

9. ACCEPTABLE USE

You must not use the App to:

  • break the law;
  • upload offensive, defamatory, or discriminatory material;
  • infringe intellectual property rights;
  • transmit viruses or malicious code;
  • gain unauthorised access to systems or data;
  • disrupt the operation of the App or others’ services.

10. LOAN PRODUCTS AND SERVICES

(a) The App may allow you to apply for loans from third-party financial institutions.
(b) By submitting a loan application, you confirm that:

  • you are at least 18 years old;
  • all information you provide is true, accurate, and complete;
  • you are applying on your own behalf (or are duly authorised to apply for an entity);
  • you will continue to record sales and expenses in the App during the loan period.
    (c) Loan terms are set by the financial institution, not by Eshango application .
    (d) By submitting an application, you authorise Eshango to share your information with the financial institution(s) you select.

11. THIRD-PARTY SERVICES & APP STORE TERMS

(a) The App may link to services or websites we do not control. We are not responsible for their content or accuracy.
(b) You must comply with the terms of external services and app stores.
(c) For Apple App Store users: Apple is not responsible for the App, its content, or support. Apple may refund purchase price if the App fails to conform to warranty, but has no further obligations. Apple is a third-party beneficiary of these Terms.
(d) For Google Play users: your use of the App must comply with Google Play Terms of Service. Google is not responsible for the App and has no liability under these Terms.

12. UPDATES TO THE APP

We may update the App from time to time to improve performance, fix bugs, or add/remove features. Please install updates promptly, as the App may not function properly otherwise.

13. SERVICE LIMITATIONS

The App is provided “as is” and we do not guarantee that:

  • it will always be error-free or available;
  • messages will be delivered on time;
  • information provided will always be accurate or secure.

14. LIABILITY

(a) Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.
(b) Subject to (a), Eshango is not liable for indirect or consequential losses, including loss of profit, revenue, or data.
(c) Our total aggregate liability under these Terms is limited to £50.

15. TERMINATION

(a) We may end this agreement if you breach these Terms. Serious breaches may result in immediate termination.
(b) On termination:

  • you must stop using and delete the App;
  • we may suspend or delete your account;
  • no refunds are due for payments already made.

16. TRANSFER & THIRD PARTIES

(a) We may transfer our rights under these Terms to another business, provided this does not materially disadvantage you.
(b) You may not transfer your rights without our written consent.
(c) Only you and Eshango may enforce these Terms (except where Apple/Google are third-party beneficiaries under section 11).

17. GOVERNING LAW & JURISDICTION

(a) These Terms are governed by the laws of England and Wales.
(b) If you are a consumer, you may also rely on mandatory protections in your country of residence.
(c) Any disputes will be subject to the non-exclusive jurisdiction of the English courts.
